§ 20-52. Definitions.

  • The following words, terms and phrases, when used in this article, shall have the meanings ascribed to them in this section, except where the context clearly indicates a different meaning:

    Appeal. A contested hearing before the city special master for review of a red light traffic control signal violation under this article.

    Authorized emergency vehicles. Ambulances and vehicles operated by the fire department or law enforcement agency when responding to an emergency.

    Intersection. The area embraced within the prolongation or connection of the lateral curb line; or, if none, then the lateral boundary lines, of the roadways of two (2) roads which join or intersect one another at, or approximately at, right angles; or the area within which vehicles traveling upon different roads joining at any other angle may come in conflict.

    Motor vehicle. Any self-propelled vehicle not operated upon rails or guideway, but not including any bicycle, motorized scooter, electric personal assisted mobility device, or moped.

    Notice of violation. A citation issued for a vehicle entering into the intersection against a steady red traffic control signal.

    Owner/vehicle owner. The person or entity identified by the Florida Department of Motor Vehicles, or other state vehicle registration office, as the registered owner of a vehicle. Such term shall also mean a lessee of a motor vehicle pursuant to a lease of six (6) months or more.

    Record images. Images recorded by a traffic control signal monitoring system/device:

    (1)

    On:

    (a)

    Two (2) or more photographs;

    (b)

    Two (2) or more electronic images;

    (c)

    Two (2) or more digital images;

    (d)

    Digital or video movies; or

    (e)

    Any other medium that can display a violation; and

    (2)

    Showing the rear of a motor vehicle and on at least one (1) image, clearly identifying the license plate of the vehicle.

    Special master. The special master hired by the city.

    Traffic control signal. A device exhibiting different colored lights or colored lighted arrows, successively one (1) at a time or in combination, using only the colors green, yellow, and red which indicate and apply to drivers of motor vehicles as provided in F.S. § 316.075.

    Traffic control signal monitoring system. An electronic system consisting of one (1) or more traffic infraction detectors.

    Traffic infraction enforcement officer. The police officer(s), public safety aide(s), and/or other persons pursuant to F.S. § 316.640(5), as designated by the chief of police to review recorded images prior to the issuance of a notice of violation.

    Traffic infraction detector. A vehicle sensor installed to work in conjunction with a traffic control signal and a camera or cameras synchronized to automatically record two (2) or more sequenced photographic or electronic images or streaming video of only the rear of a motor vehicle at the time the vehicle fails to stop behind the stop bar or clearly marked stop line when facing a traffic control signal steady red light. Any notification under [F.S.] § 316.0083(1)(b) or traffic citation issued by the use of a traffic infraction detector must include a photograph or other recorded image showing both the license tag of the offending vehicle and the traffic control device being violated.

    Violation (infraction). A traffic offense whereby a traffic control signal monitoring system established that a vehicle entered an intersection controlled by a duly erected traffic infraction detector at a time when the traffic control signal for such vehicle's direction of travel was emitting a steady red signal.
