§ 20-51. Purpose.
The purpose of this Act is to authorize the use of unmanned traffic infraction detectors to enforce F.S. § 316.074(1) or 316.075(1)(c)(1) when a driver fails to stop at a red traffic signal on streets and highways under their jurisdiction pursuant to F.S. § 316.0083. This traffic control signal monitoring system is to promote compliance with red light signals at intersections and to adopt a civil enforcement system for red light signal violations. This Act will supplement law enforcement personnel in the enforcement of red light signal violations and shall not prohibit law enforcement officers from issuing a citation for red light signal violations in accordance with normal statutory enforcement techniques. Traffic infraction enforcement officers are authorized to issue a traffic citation under these sections in addition to law enforcement officers.
A notice of violation and traffic citation may not be issued for failure to stop at a red light if the driver is making a right-hand turn in a careful and prudent manner at an intersection where right-hand turns are permissible.
