§ 20-23. Appeal.

  • Any person wishing to contest a municipal parking violation may do so by filling out the lower portion of the citation form and returning it to the Broward County Clerk of Courts in the envelope provided. The matter will then be scheduled for a hearing before a hearing officer. Decisions of the hearing officer are appealable, under the rules of the court, to the circuit court. Appeals shall be based upon the record of the hearing before the hearing officer and shall not be hearing de novo. Appellants are responsible for producing the record of the hearing beyond that which normally results from the civil traffic infraction hearing process.

Ord. No. 05O-05-151, § 4, adopted June 13, 2005, repealed the former § 20-23, and enacted a new § 20-23 as set out herein. The former § 20-23 pertained to appeal and derived from Ord. No. 05O-04-133, § 3, adopted April 25, 2005.
