§ 7½-25. Organization.

  • (a)

    Composition. The enforcement board shall consist of seven (7) members and six (6) alternates, all of whom shall be residents of the city. Each of the five (5) commissioners shall appoint one (1) member and one (1) alternate to the board. The commission as a whole shall appoint the sixth and seventh members and one (1) alternate to the board. The members of the city enforcement board shall be appointed on the basis of experience or interest in the areas of zoning and building control and shall, whenever possible, include an architect, a businessman, an engineer, a general contractor, a subcontractor and a realtor. Members of the code enforcement board shall perform ex officio all of the duties of the City of Lauderhill Public Nuisance Abatement Board, which is not deemed to be dual office-holding and is not inconsistent with Article II, Section 5(a), Florida Constitution as the nuisance abatement board and all of its duties are hereby merged into the code enforcement board.

    (b)

    Appointments; terms. The initial appointments to the enforcement board shall be as follows:

    (1)

    Two (2) members appointed for terms of one (1) year.

    (2)

    Three (3) members appointed for terms of two (2) years.

    (3)

    Two (2) members appointed for terms of three (3) years.

    Thereafter, all appointment shall be made for terms of three (3) years. Appointments to fill any vacancy on the enforcement board shall be for the remainder of the unexpired term of office. Alternate members shall serve for a one (1) year term.

    (c)

    Vacancies. Any member or alternate who fails to attend two (2) of any three (3) successive meetings without cause and without prior approval of the chairperson shall be automatically removed from the board and have his/her seat declared vacant, and the commissioner who had appointed him/her or the commission as a whole if the person was so appointed, shall promptly fill such vacancy. Members shall serve in accordance with the City Charter and the State Statutes and may be suspended or removed for causes provided therein.

    (d)

    Chairperson; quorum; compensation. The enforcement board shall elect a chairperson from among its members. The enforcement board shall meet once each week for up to four (4) weeks per month (as the caseload requires). Three (3) of the six (6) alternates shall be scheduled to attend each meeting. The procedures regarding the scheduling, prioritization, attendance of, and other procedures relating to alternates shall be established by the enforcement board. The presence of a total of four (4) or more members and alternates combined shall constitute a quorum of the enforcement board. Members and alternates shall receive fifty dollars ($50.00) per meeting for which they are scheduled to attend and actually are in attendance at. Members and alternates may be reimbursed as provided in the City Charter and the City Code of Ordinances with prior city approval.
