§ 4-26. Citation; penalties.

  • (a)

    Citations. Animal Control Officers of the City of Lauderhill under Florida Statutes, are authorized to issue citations under Chapter 4 of the Code of Ordinances and pursuant to Florida Statutes, Chapter 767. For the issuance of a citation, the animal control officer shall have probable cause to believe that the person cited has committed an act in violation of Chapter 4 of the Code of Ordinances of the City and/or Chapter 767 of the Florida Statutes.

    (b)

    Penalties. Violations of Chapter 4 of the Code of Ordinances, unless otherwise provided elsewhere in this article, shall constitute a civil infraction. Any person found to be in violation of this article shall be liable for a fine of fifty dollars ($50.00) for the first offense; a fine of one hundred dollars ($100.00) for the second repeated offense; and a fine of two hundred fifty dollars ($250.00) for the third and any subsequently repeated offense if the citation is not contested. Any person contesting the citation in county court shall be liable for a fine of up to but not exceeding five hundred dollars ($500.00) and court costs to be assessed by the court.

    (c)

    Failure to appear, failure to pay. If a person fails to pay the civil penalty or fails to appear in court, the court may issue a warrant for the persons arrest for failure to appear in court pursuant to the court ordered notice to appear for the hearing.
