Chapter 21. WATER AND SEWER SERVICE |
Article IV. DEPARTMENT OF ENVIRONMENTAL AND ENGINEERING SERVICES RULES, REGULATIONS AND RATES |
§ 21-45. Definitions.
For the purposes of this article, the terms used herein shall be defined as follows:
Consumer: Any person, firm, association, corporation, agency or similar organization supplied with refuse collection and water and/or sewer service by the department, sometimes referred to as the "customer."
Consumer's installation: All pipes, shutoffs, valves, fixtures and appliances or apparatus of every kind and nature used in connection with or forming a part of an installation for utilizing water and sewer service for any purpose, ordinarily located on the consumer's of "point of delivery," whether such installation is owned outright by the consumer or used by the consumer under lease or otherwise.
Council: The duly elected authority of the city.
Department: The department of environmental and engineering services or its representative of the city, its office address as currently shown on all department correspondence and customer bills. Hereinafter, sometimes referred to as the "utility."
In-line valve: The valve located outside the building which controls the flow of water into the building.
Main: Shall refer to a pipe, conduit or other facility installed to convey service to individual lines or other mains.
Point of delivery: The point where the department of environmental and engineering services' pipes or meters are connected with pipes of the consumer, generally, at the property line, easement line or edge of a right-of-way.
Rate schedule: Refers to the rate or charge for the particular classification of service or services.
Refuse: All waste which is collected pursuant to the city's franchise for refuse collection, removal and disposal as it now exists, or as it may be amended, extended, renewed or rewarded, and including garbage and trash receptacles which are required pursuant to section 10-13 of the Code. Required payment for these garbage and trash receptacles shall be included in refuse collection charges.
Service: As mentioned herein and in agreement with consumers, shall be construed to include, in addition to all water service or sewer service required by the consumer, the readiness and ability on the part of the department of environmental and engineering services to furnish such service to the consumer. Thus, the maintenance by the department of the availability of service at the point of delivery upon request shall constitute the rendering of service, regardless of whether the consumer makes any use thereof.
Service lines: The pipes of the department of environmental and engineering services which are connected from the mains to the point of delivery.
