§ 18-37. Approving entity; permit issuance; certificate of compliance.
(a)
Approving entity. The DEES Director or authorized delegate is responsible for fairly coordinating and administering the provisions of this article.
(b)
Newsrack permit. Within ten (10) working days of receipt of a complete newsrack permit application and fee, the DEES director or authorized delegate shall either issue or deny the permit.
(1)
Permit issuance. Upon a determination that the newsrack permit is in conformance with applicable standards and regulations, the DEES director or the director's authorized delegate, shall issue an engineering permit for the installation, operation and maintenance or removal of the newsrack.
(2)
Permit denial. Upon a determination that the newsrack permit is not in conformance with applicable standards and requirements, the DEES director or delegate shall notify in writing the person filing the permit of the reason or reasons for the denial and, if applicable, suggest alternative locations for the placement of the newsrack.
(c)
Certificate of compliance. Upon installation or removal of a newsrack, the distributor shall notify in writing the DEES that the newsrack installation or removal has been completed. The DEES shall conduct an on-site inspection to verify that the newsrack has been placed, installed or removed at the approved location.
(1)
Approval. If the DEES director or delegate determines the newsrack installation or removal is in conformance with applicable standards and regulations, a certificate of compliance shall be issued.
(2)
Denial. If the DEES director or delegate determines the newsrack installation or removal is not in conformance with applicable standards and regulations, the DEES director or delegate shall notify in writing the person filing the permit of the reason or reasons for the denial. A failed inspection shall be subject to an additional re-inspection fee of twenty-five dollars ($25.00).
(d)
Procedure. The DEES shall:
(1)
Develop and maintain a map that is to a large enough scale to show general citywide locations of newsracks by each distributor and publisher.
(2)
Conduct a citywide survey to identify the location of all existing newsrack locations by distributor and publisher and to show those locations on the above-described map.
(3)
Once an approved newsrack is placed, installed or removed, the DEES shall conduct an on-site inspection to verify that the newsrack has been placed, installed or removed at the approved location.
(4)
Amend the map to show the location of any approved newsracks by distributor and publisher.
(5)
Prepare a newsrack certificate of compliance form by December 31, 2005.
