§ 18-38. Abandonment and removal.
(a)
Abandonment. In the event a permit holder desires to voluntarily abandon a newsrack location, the permit holder shall notify the DEES in writing and, within thirty (30) days of such notification, completely remove the newsrack, mount, and concrete pad and restore the area to a safe location, leaving no holes or projections in the mounting surface and restoring any grass area.
(b)
Removal. On or after February 1, 2006, any newsrack without a valid city newsrack permit will be an illegal nonconforming structure and the Code Enforcement Division may attach a notice to remove the structure. If the newsrack is not removed or if a valid newsrack permit is not obtained within thirty (30) days after such notice is attached, the Code Enforcement Division may have the newsrack impounded. The Code Enforcement Division shall bill the expenses of such removal and storage to the publisher or distributor of the contents of the newsrack. Within thirty (30) days after removal, the newsrack shall be deemed unclaimed property in possession of the city and may be disposed of pursuant to law.
