Division 1. STREET SOLICITATION |
§ 14-95. Application procedure.
(a)
Applicants for a permit under this chapter as a solicitor or peddler must file with the city, a sworn application in writing signed by the applicant if an individual, or by all partners if a partnership, or by the president if a corporation. The applicant shall provide the following information:
(1)
Name and description of the applicant;
(2)
a.
Permanent home address and full local address of the applicant; and the address of applicant for past five (5) years;
b.
The name of the individual having management authority or supervision of the applicant's business during the time that it is proposed to be conducted in the city;
c.
The capacity in which the applicant will act;
(3)
The name and address of the person, if any, for whose purpose the business will be conducted, and, if a corporation, the state of incorporation;
(4)
A brief description of the nature, character and quality of the business and the goods or services to be offered for sale or delivery;
(5)
If employed, the name and address of the employer, together with credentials establishing the exact relationship;
(6)
The length of time for which the right to do business is desired;
(7)
The nature of the advertising proposed to be done for the business;
(8)
If a vehicle is to be used, a description of the same, together with permit number or other means of identification;
(9)
A photograph of the applicant, taken within sixty (60) days immediately prior to the date of filing of the application, which shall be at least two (2) inches by two (2) inches, showing the head and shoulders of the applicant in a clear and distinguishing manner, and fingerprints of the applicant;
(10)
Proof of insurance coverage for a public liability and property damage insurance policy or commitment with a company authorized to transact business in the state to secure payment of any loss or damage resulting from any accident arising out of or caused by the operation of said solicitor or peddler. Failure to maintain appropriate insurance coverage shall be deemed sufficient grounds for revocation of the permit as set forth in section 14-98;
(11)
Signed agreement to hold harmless the city and its officers, agents, and employees; and
(12)
Authorization for release of information and for conducting a criminal records background check in connection with the investigation of the application pursuant to section 14-96 herein.
(b)
At the time of filing the application, a nonrefundable fee of two-hundred fifty dollars ($250.00) shall be paid to the city to cover the cost of investigation of the facts stated therein.
(c)
No individual under the age of eighteen (18) shall be qualified to apply for a permit or to conduct or take part in any activities under this chapter as a solicitor or peddler.
