§ 14-63. Attractive nuisances; abandonment.

  • (a)

    Prohibiting abandonment in places accessible to children. It shall be unlawful for any person, firm or corporation to leave or permit to remain outside of any dwelling, building or other structure or within any unoccupied or abandoned building, dwelling or other structure under his or its control in a place accessible to children any abandoned, unattended, unsightly attractive nuisances, including but not limited to discarded automobiles, iceboxes, refrigerators, washing machines, dryers, water heaters, toilet fixtures, earth-moving equipment, construction equipment, large cardboard containers and all other airtight containers and other such items.

    Discarded automobile shall mean any vehicle which does not have an identifiable owner or which has been disposed of in a wrecked, inoperative or partially dismantled condition, including but not limited to vehicles with broken windows, peeling paint, rust over fifty (50) per cent of the body, no tires or no engine.

    (b)

    Penalties. Any person, firm or corporation violating any of the provisions of this section shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined in an amount not exceeding five hundred dollars ($500.00) or be imprisoned for a period not exceeding thirty (30) days or be both so fined and imprisoned. Each day such violation is committed or permitted to continue shall constitute a separate offense and shall be punishable as such hereunder.
