§ 12-206. Applicability of article to existing businesses.

  • (a)

    Licensing requirements. All preexisting sexually oriented businesses lawfully operating in the city in compliance with all state and local laws prior to the effective date of this article, and all sexually oriented business employees working in the city prior to the effective date of this article, are hereby granted a De Facto Temporary License to continue operation or employment for a period of ninety (90) days following the effective date of this article. By the end of said ninety (90) days, all sexually oriented businesses and sexually oriented business employees must apply for a license under this article.

    (b)

    Interior configuration requirements. Any preexisting sexually oriented business that is required to, but does not, have interior configurations or stages that meet at least the minimum requirements of section 12-203 and subsection 12-207(b) shall have ninety (90) days from the effective date of this article to conform its premises to said requirements. During said ninety (90) days, any employee who appears within view of any patron in a semi-nude condition shall nevertheless remain, while semi-nude, at least six (6) feet from all patrons.

    (c)

    Other requirements. Except as provided for in subsections 12-206(a) and (b), sexually oriented businesses shall comply with this article on the date that it takes effect.
