§ 12-94. Major known defect standards.
The dealer shall be required to disclose on the buyer's guide any defect set forth below if known. For the purposes of this article, a used vehicle has defects if it satisfies the criteria set forth below:
(a)
Frame and body:
(1)
Frame has cracks, corrective welds or is rusted through.
(2)
Bent or twisted frame.
(b)
Engine:
(1)
Oil leakage.
(2)
Cracked block or head.
(3)
Knocks or misses related to camshaft lifters and rods.
(4)
Abnormal exhaust discharge.
(c)
Transmission and drive shaft:
(1)
Improper fluid level or leakage.
(2)
Cracked or damaged case.
(3)
Abnormal noise or vibration caused by faulty transmission or drive shaft.
(4)
Improper shifting.
(5)
Manual clutch slips or chatters.
(d)
Differential:
(1)
Improper fluid leakage.
(2)
Cracked or damaged housing.
(3)
Abnormal noise or vibration.
(e)
Cooling system:
(1)
Leakage, including radiator.
(2)
Improperly functioning water pump.
(f)
Electrical system:
(1)
Battery leakage.
(2)
Improperly functioning alternator, generator, battery or starter.
(g)
Fuel system:
(1)
Visible leakage.
(h)
Inoperable accessories:
(1)
Gauges or warning devices.
(2)
Air conditioner.
(3)
Heater and defroster.
(i)
Exhaust system:
(1)
Leakage.
(j)
Brake system:
(1)
Failure warning light broken.
(2)
Pedal not firm under pressure.
(3)
Not enough pedal reserve.
(4)
Does not stop vehicle in straight line.
(5)
Drum or rotor too thin.
(6)
Lining or pad thickness less than one-thirty-second ( 1/32 ) of an inch.
(7)
Power unit not operating, or leaking.
(k)
Steering system:
(1)
Too much free play at steering wheel.
(2)
Free play in linkage more than one-quarter (¼) of an inch.
(3)
Steering gear binds or jams.
(4)
Front wheels aligned improperly.
(5)
Power unit fluid level improper.
(l)
Suspension system:
(1)
Ball joint seals damaged.
(2)
Structural parts bent or damaged.
(3)
Stabilizer bar disconnected.
(4)
Spring broken.
(5)
Shock absorber mounting loose.
(6)
Rubber bushings damaged or missing.
(7)
Radius rod damaged or missing.
(8)
Shock absorber leaking or functioning improperly.
(m)
Tires:
(1)
Tread depth less than two-thirty-seconds ( 2/32 ) of an inch.
(2)
Sizes mismatched.
(3)
Visible damage.
(n)
Wheels:
(1)
Visible cracks, damage or repairs.
