§ 12-93. Consumer sales; window form.

  • (a)

    Before a dealer offers a used vehicle for sale to a consumer, the dealer must prepare, fill in as applicable and display on that vehicle a "used car buyer's guide." A copy of the used car buyer's guide to be utilized by the dealer is on file in the office of the city clerk and made a part hereof by reference thereto.

    (b)

    The dealer shall display the used car buyer's guide on a side window of the vehicle. The dealer may remove the form temporarily from the window during any test drive.

    (c)

    The used car buyer's guide must be in substantially the same form as is the used car buyer's guide form attached to Ordinance No. 82-137, on file in the office of the city clerk.

    (d)

    The purpose of the used car buyer's guide is to advise the consumer if any of the vehicle's systems are covered by a warranty and which systems are known by the dealer to contain major defects.

    (e)

    The dealer shall complete all information required on the used car buyer's guide and disclose, in the place provided on the form, whether any systems of the vehicle are covered by a warranty, the limits of such warranty, and which systems are known by the dealer to contain major defects.

    (f)

    The dealer may disclose the information concerning warranties for the car and systems covered by inserting, in the appropriate section, one (1) of the following:

    Condition of Systems of this Vehicle:

    (1)

    Excellent—Six-month, one hundred (100) per cent warranty.

    (2)

    Good—Ninety-day, one hundred (100) per cent warranty.

    (3)

    Unknown—No warranty.
