§ 9-52. Violations; procedure for correction.
(a)
Generally. Whenever any inspector as herein authorized shall find any violations, he/she shall order said conditions to be corrected; and such order shall forthwith be complied with by the owner or occupant. The service of any such order may be made upon the occupant of the premises by delivering to such occupant in person or by delivery to any person in charge of the premises or by posting a copy thereof in a conspicuous place upon the premises.
Failure to comply with a lawful order as herein provided shall constitute an offense, and each day such failure continues shall be deemed a separate offense. However, all violations shall abate during the pendency of an appeal.
(b)
Appeals. Whenever any inspector as herein authorized shall order any violation of the fire code corrected, if the violation arises out of the Florida Fire Prevention Code, any appeal shall be made to the Broward County Board of Rules and Appeals. If a violation is found to exist pursuant to such appeal, the violation shall be corrected within such time as specified by the inspector.
(c)
Correction. Whenever any inspector as herein authorized shall order any violation corrected, and the violation arises out of Chapter 9 of the Code of Ordinances of the city, any appeal shall be made to the chief of the Lauderhill Fire Department. The appeal shall be made within twenty-four (24) hours of the service of the order of violation. The chief of the fire department shall consider the matter and determine whether or not a violation in fact exists. If a violation is found to exist pursuant to such appeal, the violation shall be corrected within such time as specified by the inspector.
