§ 9-22. Fire rescue standby detail.

(a)

The fire chief or his designee may require the owner, agent or lessee to employ one (1) or more certified fire inspectors or firefighters, as required and approved by the fire chief or his designee, to be on duty at any building, premises, structure, place of assembly, or other place where people congregate whenever the fire chief or his designee determines it is necessary for the public safety due to the number of persons or to the nature of the event, performance, exhibition, display, contest, or activity to take place. The certified fire inspectors or firefighters shall be subject to the fire chief's, or his designee's, orders at all times when so employed and while remaining on duty during the time such places are open to the public, or during the time when such activity or event is being conducted. Before each performance or the start of such event or activity, such fire inspector or firefighter shall inspect all required fire and life safety equipment to insure that such equipment is in proper working order, and shall keep diligent watch for any emergency that may arise. Should any emergency arise, the certified fire inspector or firefighter shall take whatever action is necessary to protect the occupants and the public from injury or any life-threatening condition.

(b)

The owner, agent, or lessee responsible for the need for the fire rescue standby detail will pay the city its actual labor costs for providing the detail, plus an additional twenty-percent administrative processing fee.

(c)

Fire rescue standby detail payments are due within thirty (30) days after the city mails the invoice to the owner, agent, or lessee. A late payment penalty shall accrue at a rate of five (5) percent per month or per any part of a month that the payment is past due.
