§ 6-40. Unsafe structures board created; composition of board.

  • (a)

    There is hereby created an unsafe structures board. The board shall consist of nine (9) members, with each member of the city commission having one (1) appointment to the board, and the city commission as a whole having four (4) appointments to the board. The members of the board shall be permanent residents of the city, and shall possess outstanding reputations for civic activity, interest, integrity, responsibility and business or professional ability. The composition and representative members of the board, shall include the following: a registered engineer, a registered architect, a general building contractor, an electrical contractor, an attorney-at-law, a plumbing contractor, a real estate appraiser, a real estate property manager and a citizen with experience and background in the field of social problems.

    (b)

    For the initial composition of the board, three (3) members shall serve for an initial term of two (2) years, three (3) members shall serve for an initial term of three (3) years, and three (3) members shall serve for an initial term of four (4) years. Thereafter, all appointments shall be for a term of three (3) years; provided, however, that the term in all instances shall continue until a successor is appointed and qualified. Appointments to fill any vacancy on the board shall be for the remainder of the unexpired term, but failure to fill a vacancy shall not invalidate any action or decision of the board.

    (c)

    Vacancies occurring during a term shall be filled by the city commission within sixty (60) days for the remainder of such term. The failure to fill a vacancy shall not invalidate any action or decision of the board.

    (d)

    In addition to the nine (9) members of the board, the city commission may appoint up to two (2) alternate members to serve in place of a member of the board if necessary. An alternate member shall serve for a term of two (2) years.

    (e)

    Any member of the board may be removed by the city commission for misconduct, incompetence or neglect of duty.

    (f)

    No member shall receive any compensation, except that each member shall be entitled to reimbursement for travel in the amount of twenty-five dollars ($25.00) per meeting they attend. In addition, board members may be entitled to reimbursement for necessary expenses incurred in the performance of their official duties, upon written approval by the city commission.

    (g)

    The unsafe structures board shall select one (1) of its members as chairman and one (1) as vice-chairman to act in the absence of the chairman, and it shall establish rules and regulations for its own procedures. The board shall elect other officers as may be deemed necessary or desirable, who shall serve at the will of the board. Officers shall hold office for a period of one (1) year.

    (h)

    The rules and regulations of the board shall include:

    (1)

    That five (5) members shall constitute a quorum necessary to hold a meeting or take any action, and decisions shall require the concurring votes of the majority of the members present at a duly constituted meeting.

    (2)

    That no member shall vote on any proposal in which he/she has a personal or financial interest.

    (3)

    The building official, or his/her designee, shall be the secretary of the board, but shall have no vote.
