§ 6-4. Sodding and landscape requirements.
(a)
All builders and developers within the city shall, at some appropriate time during the course of any construction within the city, provide for and complete the sodding, landscaping, or provision of ground cover upon the lot where new construction is taking place.
(b)
The sodding, landscaping or other provision of the area shall be inspected by the building inspector and the building inspector shall certify to the proper completion of such sodding or landscaping.
(c)
Nothing contained herein shall be construed as to preclude the use of creative landscaping involving gravel, tile, etc., instead of grass so long as a completed, landscaped appearance is achieved.
(d)
No builder or developer shall be entitled to obtain a certificate of occupancy until such landscaping, sodding or the provision of such an area shall be completed and approved by the building inspector of the city.
(e)
In the event the completed construction meets all requirements of the building department of the city for the issuance of a certificate of occupancy, with the exception of the completion ofsodding or landscaping, then and in that event the builder or developer may post a completion bond in an amount to be established by the chief building inspector of the city, the amount to be sufficient to complete the sodding or landscaping and following the posting of said completion bond, the certificate of occupancy may be issued. In the event, however, that said completion bond is posted, then and in that event the landscaping shall be completed within thirty (30) days thereafter, or the said completion bond shall be deemed forfeited to the city.
