§ 2-88.51. Definitions.
For the purpose of this article the following definitions shall apply:
Affected person: Any local government; any employee, officer, resident of the city, or owner or operator of a business within the city. Each person must file, in order to qualify as an affected person under this definition, a complaint and request for prosecution with the City of Lauderhill Public Nuisance Abatement Board regarding the existence of a public nuisance located within the City of Lauderhill.
Nuisance abatement board: The board created consistent with section 2-88.53 and in accordance with Florida Statutes, Section 893.138. The code enforcement board shall be the City of Lauderhill's Public Nuisance Abatement Board and shall perform ex officio all of the necessary duties of the public nuisance abatement board.
Nuisance abatement supervisor: The city manager or his/her designee.
Premises: Any store, shop, warehouse, dwelling unit, building, structure, vehicle, ship, boat, vessel or aircraft, booth, tent or place, furniture, fixtures, equipment, and contents.
Public nuisance: Any place or premises which tends to annoy the community or injure the health of the citizens in general or becomes manifestly injurious to the public morals or manners, and which has been used on more than two (2) occasions within a six-month period:
(1)
As the site of the unlawful sale, delivery, manufacture or cultivate of controlled substances, or
(2)
By a criminal gang for the purpose of conducting criminal gang activity as defined by Florida Statutes, Section 874.03, or
(3)
For prostitution, or solicitation of prostitution, or lewd or lascivious behavior in violation of Florida Statutes, Section 796.07.
(4)
In violation of Florida Statutes, Section 812.019 relating to dealing in stolen property.
(5)
Any pain-management clinic as described in Florida Statutes, Sections 458.3265 or 459.0137 which has been used as the site of a violation of:
a.
784.011, 784.021, 784.03, or 784.045 relating to assault and battery;
b.
Section 810.02 relating to burglary;
c.
Section 812.014 relating to dealing in theft;
d.
Section 812.131 relating to robbery by sudden snatching; or
e.
Section 893.13 relating to the unlawful distribution of controlled substances.
(6)
Any premises or place declared to be a nuisance by Florida Statutes, including, but not limited to Chapter 823, Sections 823.05, 823.10, or 823.13, and Section 893.138, as they may be renumbered or amended from time to time.
