§ 19-16. Declaration of intent.

  • It is the intent of the council to impose a valid and constitutional tax, and if any tax rate is deemed unlawful as denying equal protection or due process, by a court of competent jurisdiction, then such rate shall be levied and collected at the maximum rate of ten (10) percent on all utility services subject to the provisions of this article.

    If any other provision of this article is held to be unconstitutional and void, or ultra vires, by a court of competent jurisdiction, such holding shall not invalidate other provisions of this article, it being the interest of the council to enact this article without such unconstitutional or ultra vires provisions.
