§ 18-34. Engineering permit and fee required.
(a)
Compliance. It shall be unlawful and a violation of the Code of Ordinances for any person to place, install, operate, maintain or remove a newsrack except in conformance with the standards and requirements of this article.
(b)
Effective date. Any person who owns, leases, rents or otherwise has an interest in an existing newsrack located within the city shall have until February 1, 2006, to file and obtain an engineering permit for each affected newsrack.
(c)
Engineering permit and fee. Any person wanting to place, relocate or install a newsrack within a public right-of-way must file an engineering permit and fee with the Department of Environmental and Engineering Services (DEES). The permit fee is ten dollars ($10.00) plus a twenty-five dollar ($25.00) inspection fee per newsrack.
(d)
Engineering permit form. The DEES may use an existing permit form or shall prepare a newsrack permit form by December 31, 2005. The newsrack permit form shall, at a minimum, provide for the following information:
(1)
The name, address, and telephone number of the person owning the specified or equivalent newsrack;
(2)
The name, address, and telephone number of a responsible person whom the city may notify or contact at any time concerning the owner's newsrack;
(3)
The number of specified newsrack or the number, type or brand, and model of equivalent newsracks, including a description and illustration of its exterior elevations showing its dimensions, size, color, and other features;
(4)
A cross-section showing the subsurface, the ground mounting surface, the pedestal mounting surface, and how the pedestal and specified or equivalent newsrack is secured to the surfaces;
(5)
The names of the publications to be contained in the specified or equivalent newsrack and the dimensions, size, colors and font of the letters; and
(6)
Any other information deemed appropriate and suitable by the city engineer.
