Division 1. STREET SOLICITATION |
§ 14-91. Findings and purpose.
It is found and declared that:
(1)
The purpose of the public streets and sidewalks is for use by vehicular and pedestrian traffic.
(2)
The prohibition of street and sidewalk solicitation is necessary to protect the health, safety and welfare of the travelling public. Municipalities are granted the power to protect the health, safety, and welfare of its residents by preventing the obstruction of free and safe movement of vehicular traffic on its roads in accordance with the Florida Constitution, Article VIII, Section 2(b), and F.S. §§ 316.2045 and 337.406.
(3)
The regulations contained in this article do not restrict the pure speech rights of organizations, but merely regulate the activities of organizations which are commercial in nature or which present safety hazards to the general public.
(4)
The regulations contained in this article are not intended to restrict the rights of newspaper vendors and do not apply to newspaper vendors.
