§ 14-71. Definitions.

  • [The following terms, when used in this article, shall have the meanings ascribed to them in this section, except where context clearly indicates a different meaning:]

    Alarm administrator shall mean the chief of police or his/her designee.

    Alarm business shall mean any person engaged in selling, leasing, maintaining, servicing, repairing, altering, replacing, moving or installing any alarm system or in causing any alarm system to be sold, leased, maintained, serviced, repaired, altered, replaced, moved or installed in or on any building, structure, facility or enclosed area.

    Alarm signal shall mean the audible sound or a transmission of a signal or a message as the result of the activation of an alarm system or an audible alarm.

    Alarm site shall mean a single premise or location served by an alarm system or systems.

    Alarm system shall mean a device or system that emits, transmits, or relays a signal intended to summon, or that would reasonably be expected to summon police and/or fire services of the city. Alarm systems shall not include:

    (1)

    Vehicle alarms unless the vehicle is a permanent part of the site.

    (2)

    An alarm that is designed to alert only the inhabitants of the premises but which does not transmit a signal to a monitoring company, or that does not have an audible local alarm (i.e. internal alarm only).

    Alarm user shall mean a person(s), firm, partnership, corporation, association, limited partnership, sole proprietorship, organization, company, or any other entity who owns the property where an alarm system is installed.

    Audible alarm shall mean a device designed for the detection of unauthorized entry on premises which generates an audible sound when it is activated.

    False alarm shall mean activation or transmission of any alarm signal caused by human error, mechanical or electronic malfunction, negligence of the alarm user or the alarm user's employees, whether or not the exact cause of the alarm activation is determined, or any other activation or transmission of any alarm signal where no actual or attempted criminal act, life-threatening situation, loss of property situation or fire exists. Severe weather, power outages, transmission line malfunctions, acts of God, malicious acts of persons not under the control of the user, or any other cause clearly beyond the control of the alarm user will be considered in determining if an alarm activation was false, and whether or not any fee, warning or other punitive action will be taken against the alarm user as provided for by this article.

    Local alarm shall mean an alarm system that emits a signal at an alarm site that is audible or visible from the exterior of the structure.

    Notice shall mean written notice, given either by certified mail, return receipt requested, by personal service upon the addressee, or the posting of a notice on the property.

    Permit holder shall mean the person designated in the application as required in this article, who is responsible for responding to alarms and giving access to the site.

    Person shall mean any natural person, individual, any firm, partnership, association, limited partnership, sole proprietorship, corporation, organization or any business entity whatsoever.

    Police chief means the police chief of the city.
