Article II. CERTIFICATE OF USE AND LOCAL BUSINESS TAX RECEIPT |
§ 12-55. Fundraising events.
Each holder of a certificate of use and local business tax receipt for ownership of commercial property shall be entitled to hold two (2) fundraising events per calendar year without obtaining an additional certificate of use or local business tax receipt or paying an additional tax. To quality for this fundraising event exemption, the holder of the certificate of use and local business tax receipt for that business and the event must meet all of the following conditions:
(1)
The event shall not be subject to Chapter 12, Article X, Special Events.
(2)
No business shall receive any revenue from the proceeds of the event. No paid employees shall work at the event.
(3)
The event shall be run by a non-profit organization and shall not have more than five (5) people working at any one time, unless otherwise authorized in writing by the director of the department supervising code enforcement.
(4)
The event shall not attract a group of more than ten (10) people at any one time, not including the workers described in subsection (3) above.
(5)
No City of Lauderhill resources are requested or required for the event.
(6)
Any event involving the sale of food shall meet all requirements of the Broward County Health Department and shall provide evidence of compliance.
(7)
The director of the department supervising code enforcement or the chief code enforcement officer shall determine whether the event meets the criteria for exemption.
A holder of the certificate of use and local business tax receipt for the business may hold a fundraising event without obtaining a permit, however, if the event is determined to require a special event permit, or is not allowed at all, by code enforcement, the holder of the certificate of use and local business tax receipt for the business may be required to immediately end the event and may be cited with a notice of violation and/or a civil citation. Holders of certificates of use and business tax receipts may request that the code enforcement department review their plans for an event and issue a written opinion that the event meets the criteria for exemption. Such an opinion, however, shall not be binding if code enforcement determines that the actual event violates the provisions above or other provisions of the Code of Ordinances or land development regulations.
