§ 10-4. Same—Location; screening; permits.

  • (a)

    All garbage and trash receptacles as provided for herein shall be maintained only at the rear or side of any residence or business establishment within the city. For front door garbage and trash pickup, such garbage and trash receptacles may be placed at the front of any resident or business establishment within the city not prior to 6:00 p.m. on the night before the scheduled date of pickup; and said garbage and trash receptacles must be removed from the front of any residence or business establishment not later than 6:00 p.m. upon the day of the said pickup for collection of garbage and trash at the said residence or business establishment.

    Each property that utilizes trash pickup service and violates these code provisions shall be subject to a garbage violation notice which imposes a warning or fees depending on the number of violations of subsection (a) of this section based upon the number of violations within a twelve (12) month period based upon a calendar year subject to the following schedule:

    (2)

    It is unlawful for any person to refuse or fail to pay fees or fines associated with the violations of this section. All fines and fees due to the city must be paid by the person to whom the water/utility bill is registered with the city (i.e. the property owner or the trash pickup user where applicable). The ultimate responsibility for payment will lie with the property owner.

    (3)

    Fines and fees not paid within thirty (30) days of the billing date will be assessed a ten (10) percent penalty on the outstanding balance. All fines and fees not paid after ninety (90) days will be turned over to a collection agency selected by the city for collection. The violator will be responsible for all costs associated with this action up to and including legal fees.

    (4)

    This section shall be enforced by the code enforcement division of the city through the issuance of garbage violation notices which shall be forwarded to the finance department of the city for tracking and billing. The fines assessed for each violation as indicated in the schedule above will be billed on the water/utility bill.

    (b)

    Receptacles referred to in section 10-3 shall be enclosed by a solid fence on three (3) sides, which fence shall be no less than four (4) feet high and which shall, in any event be as high as the receptacle enclosed therein, if such receptacle is greater than four (4) feet high. There shall be a curb of approximately six (6) inches in height and sufficient to prevent the garbage receptacle contained in the enclosed area from rolling across said curb across the open side of the enclosed area.

    (c)

    No building permit shall be issued by the building department until the building official has issued a permit for the construction and location of containers for the storage and collection of garbage and trash. Said permit shall ensure the compliance with the provisions of this chapter relating to location of receptacle for storage and collection of garbage and trash, including, but not limited to, bulk containers.

    (d)

    The fee for the insurance of such permit shall be in the amount of three dollars ($3.00).

    (e)

    This section shall not be applicable to garbage receptacles maintained in the interior of buildings.
