§ 7. Right of company to remove individual shelters.

  • Except as provided for in this section, the company shall not remove any shelters installed at a bus stop location during the term of this contract without first having obtained the written consent of the city. In the case of chronic vandalism of a particular shelter, the company must first give written notice to the city of any damaged shelters the company believes are subject to chronic vandalism, and the city shall have a twenty-one-day period of time to correct such problems. If the city is unable to correct ongoing problems or cannot give reasonable assurances for the safety of the shelter at that location, then it is agreed that the company shall have the right to remove individual shelters (after ten (10) days' written notice to the city) without seeking prior approval from the city in the event that such shelters have been subjected to chronic vandalism. For the purposes hereof, the phrase chronic vandalism shall be defined as damages inflicted to an individual shelter during any three-consecutive-month period which require cumulative expenditures for replacements and repair that exceed one thousand dollars ($1,000.00).
